Federal High Court Warri Declares INEC Delineation Report a Proposal, Not Final Document
The Federal High Court, Warri Judicial Division, has held that the Independent National Electoral Commission (INEC) report dated April 4, 2025, on constituency delineation remains a proposal and not a final document.
Delivering judgment on Thursday, May 15, 2026, His Lordship, Honourable Justice H. A. Nganjiwa stated that INEC must ensure that stakeholders’ feedback and concerns are fully received and considered before the report can be finalized.
The court also delivered judgments in several delineation-related suits filed by Ijaw and Urhobo plaintiffs against INEC and other parties, dismissing all six cases.
The dismissed suits include:
FHC/WR/CS/49/2025 – Mr. Newman Kusimi & 2 Ors v. INEC & Anor
FHC/WR/CS/50/2025 – Chief Benson Dubele & Anor v. INEC & Ors
FHC/WR/CS/51/2025 – Mr. Clement Tekedor & Ors v. INEC
FHC/WR/CS/33/23 – Chief Monday Keme v. INEC
FHC/WR/CS/31/2026 – Chief Westham Adehor & 5 Ors v. INEC & Ors
FHC/WR/CS/75/2025 – Chief Lucky Oromoni & 3 Ors v. INEC
The Ijaw-backed cases and the Urhobo-backed suit were all dismissed by the court in the case led by defendant counsel Chief Robinson Ariyo Esq.
Reacting to the judgments, Tsaye Edeyibo Mene, leader of the group that applied to join the cases and raised objections which led to the dismissal of the suits, described the rulings as “a victory for the rule of law and democracy.”
She maintained that the judgments reaffirm the need for due process, stakeholder engagement, and lawful consultation in the ongoing delineation exercise by INEC.
